Privacy Policy for Customers Regarding Personal Data Processing

Pursuant to Legislative Decree no. 196/2003 and EU Regulation no. 679/2016 (GDPR) and in relation to the personal data concerning You that will be processed, We inform You of the following.

1. PURPOSES OF DATA PROCESSING

GLOBAL MOVING SRL, as the data controller, will process the customer’s data for the following purposes:

  • assessments regarding the opportunity to conclude the contract (customer’s financial capacity and potential reputational impacts of the relationship, anti-corruption and anti-money laundering obligations);
  • conclusion, management, and execution of contracts entered into with the customer;
  • legal obligations related to civil, fiscal, and accounting regulations; fulfillment of obligations deriving from stipulated contracts; technical assistance and support regarding the products and services You have purchased, including after-sales and any warranty period if expressly provided; administrative management of relationships.

2. LEGAL BASES FOR DATA PROCESSING

The customer’s personal data will be processed based on the consent expressed by signing this privacy notice.

We inform You that, even in the event of refusal or withdrawal of consent, Your personal data may still be processed in the following cases and based on the following legal grounds:

  • when processing is necessary for the performance of a contract to which You are a party, or to take steps at Your request prior to entering into a contract;
  • when processing is necessary to comply with a legal obligation to which GLOBAL MOVING SRL is subject;
  • when processing is necessary to protect the vital interests of a natural person;
  • when processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in GLOBAL MOVING SRL;
  • when processing is necessary for the legitimate interests pursued by GLOBAL MOVING SRL; in particular, legitimate interests may include:
    • the interest in concluding, managing, and executing the contracts referred to in point 1 letter b);
    • the interest in protecting its rights arising, directly or indirectly, in relation to the aforementioned contracts;
    • the interest in protecting the company’s security and assets;

provided that the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data do not prevail.

3. DATA PROVISION

Without prejudice to the autonomy of the data subject, the provision of personal data directly collected may be:

  • mandatory by law, regulation, or EU legislation or based on provisions issued by Authorities authorized by law or supervisory and control bodies;
  • strictly necessary for the conclusion of new relationships between the customer and GLOBAL MOVING SRL or for the management and execution of existing relationships.

Any opposition to data processing and/or refusal to provide personal data by the data subject may result in the impossibility or refusal, in whole or in part, to enter into new contracts with the company or to execute existing ones, to fulfill obligations established by laws, regulations or EU legislation, or by provisions issued by Authorities authorized by law and supervisory and control bodies.

4. DATA COLLECTED FROM THIRD PARTIES

We inform You that the personal data subject to processing, particularly in relation to the purposes set out in point 1, letter a), may be acquired not from the data subject themselves but from third parties, through access to public databases or by using dedicated inspection services.

5. METHODS OF DATA PROCESSING

The processing of personal data may be carried out using both analog and electronic or otherwise automated means, with methods and procedures strictly necessary to achieve the purposes described above.

GLOBAL MOVING SRL carries out processing directly through persons belonging to its organization or by relying on external parties. Such parties will process the data:

  • in accordance with the instructions received from the Data Controller, respectively as authorized persons or processors, and exclusively for the achievement of the specific purposes indicated in this privacy notice.
  • independently, as autonomous controllers.

6. COMMUNICATION AND DISCLOSURE OF DATA

Personal data, exclusively for the purposes referred to in point 1, may be communicated to:

  • employees or collaborators of GLOBAL MOVING SRL authorized by the company to process data;
  • credit institutions, service companies for the registration, enveloping, transport, and sorting of documents, contractors or service providers, notaries, lawyers, experts, consultants, and specialized companies for debt recovery, auditing firms;
  • subjects to whom communication is required in compliance with collective agreements (e.g. trade unions) or specific regulatory obligations (e.g. public security entities or other public authorities).
Any data disclosure operations are excluded.

7. INDIVIDUAL RIGHTS

Data protection laws (arts. 7-10 of Legislative Decree 196/2003 and arts. 12-22 of EU Regulation 679/2016) guarantee the right to be informed about data processing, the right to access data at any time, and to request their update, integration, and correction. Where conditions under the law are met, the data subject may also exercise the right to deletion, restriction of processing, data portability, objection to processing, and not to be subject to decisions based solely on automated processing.

Where data processing is based on the data subject’s consent, the data subject has the right to revoke the consent given.

Should You believe Your rights have been violated, You may lodge a complaint with the Data Protection Authority.

8. PERSONAL DATA RETENTION

Personal data will be retained for the period necessary to achieve the purposes set out in point 1 and, after those purposes are fulfilled, until the expiry of the statute of limitations for any rights arising between You and GLOBAL MOVING SRL as a result of the legal and factual relationships directly or indirectly connected to those purposes (10 years).

9. PROCESSING OF THIRD-PARTY DATA

The customer is informed that, if involving third parties (e.g., representatives, employees, collaborators) in the execution of contracts entered into with GLOBAL MOVING SRL, the personal data of such third parties may be processed by GLOBAL MOVING SRL, always as the data controller, for the purposes referred to in point 1 and in particular for managing contacts with the customer’s representatives and appointees.

Such processing has the same purposes, methods, and retention periods as described in this privacy notice; furthermore, the data subjects have the same rights identified in point 8.

The customer undertakes to properly inform the data subjects involved about the aforementioned processing, including by providing them with this privacy notice and obtaining their signature as acknowledgment of receipt.
